Maryland Attorney General AG Frosh takes legal action against Insys Therapeutics, maker of Subsys (Fentanyl)

Maryland AG Brian E. Frosh

Recently the Attorney General’s office in Maryland brought legal charges against the pharmaceutical company, Insys maker of the killer opioid, Subsys (Fentanyl) for endangering the lives of consumers in off-label marketing their billion dollar drug.  These charges lend themselves to ask — why did the maker of OxyContin, Purdue Pharma unleash an epidemic of death and addiction throughout the country for almost two decades with virtually no concern or charges by any Attorney General as the body bag count mounted and we continue to lose a generation of our children?  Why did no federal agency consider charging Purdue Pharma under the Racketeer Influenced and Corrupt Organizations Act (RICO) in 2007 when they were charged in Federal Court in Virginia with criminally marketing OxyContin — pleaded guilty — and are convicted felons?

(MYRTLE BEACH) “RICO” is often thought of as a law designed to combat the Mafia. While that is how the law was first primarily used and intended, it has been applied in cases involving organizations that few people would mistake for the Mafia, including Major League Baseball, the Key West Police Department and the Catholic Church. RICO creates criminal and civil penalties for members of organizations that engage in patterns of criminal activity.  Why wasn’t Purdue Pharma charged under RICO?

Opioid Epidemic rages as DOJ refuses a Freedom of Information (FOI) request!

Richard Hollawell

There is an attorney in N.J. I refer to as the “Lone Ranger” fighting the prescription opioid epidemic destroying lives in the tens of thousands by taking appropriate legal action.  His name is Richard (Rick) Hollawell (photo shown).

(MYRTLE BEACH) Attorney Richard Hollawell has been seeking the very sought after 120 page report on Purdue Pharma, maker of OxyContin that caused the US Attorney’s office in Abingdon, VA to charge the pharmaceutical company in 2007 with criminally marketing their killer drug.  Three executives from Purdue Pharma pleaded guilty in Federal Court to the charges, Michael Friedman, Howard Udell and Paul Goldenheim.  No prison time was imposed and business continued as usual for Purdue Pharma.  So much so that eleven years later their profits surpass $30 billion with death and addiction tolls in the tens of thousands.

Maura Healey, Attorney General, Massachusetts and her lawsuit against Purdue Pharma

Maura Healey

Recently AG Healey “took on” the maker of OxyContin, Purdue Pharma, but did she really?

Marianne Skolek-Perez Global News Centre

(MYRTLE BEACH) Massachusetts Attorney General (AG) Maura Healey filed a lawsuit against the multi-billion dollar pharmaceutical company, Purdue Pharma, maker of the highly addictive OxyContin.  The AG alleged that Purdue Pharma misled consumers about OxyContin’s addiction and health risks in order to increase its profits.  She also named the Sackler family, owners of Purdue Pharma, as well as members of the pharmaceutical company’s Board of Directors.  Interesting approach, but one that made me very curious.  So I will make some observations, ask some questions and maybe, I will receive some answers because some things do not quite sit well here,

FDA can be sued in Prescription Opioid Epidemic — and should be!

The FDA’s approval of dangerous prescription opioids over the years can best be described as “fire, aim, ready” as the epidemic continues to rage out of control.

(MYRTLE BEACH)  Attached is a Memorandum of Law in Support of Plaintiff (Pharmaceutical Manufacturing Research Services Inc’s (PMRS) Motion for Summary Judgment filed against the United States Food and Drug administration (FDA) and the United States Department of Health and Human Services (HHS).  I encourage every Attorney General and law firm in the country suing Purdue Pharma, maker of OxyContin to read this filing carefully and apply it to current and future lawsuits.

Insys Therapeutics and Purdue Pharma “war criminals” responsible for opioid deaths and addictions!

Purdue Pharma CEO's Howard Udell, Chief Counsel, Paul Goldenheim, MD and Michael Friedman

President Trump calls for extermination of drug dealers responsible for causing deaths.  Should he include the pharmaceutical executives who knowingly marketed their dangerous opioids criminally which resulted in tens of thousands of deaths?

Last night, NBC Nightly News televised a segment on Insys Therapeutics and their criminal marketing of Subsys (Fentanyl) which has resulted in a landmark outcome — the arrest of CEO’s of the disgraced pharmaceutical company.  Here is a link to the NBC Nightly News broadcast https://www.nbcnews.com/nightly-news/video/drug-company-bribed-doctors-to-prescribe-opioid-federal-indictment-says-1189045827628
