(MYRTLE BEACH) Consider how many lives could have been saved if those responsible for the prescription opioid epidemic had been charged under RICO.  Why should they have been charged and what exactly is RICO?  Here is a simplified definition for those not familiar.

Recently the Attorney General’s office in Maryland brought legal charges against the pharmaceutical company, Insys maker of the killer opioid, Subsys (Fentanyl) for endangering the lives of consumers in off-label marketing their billion dollar drug.  These charges lend themselves to ask — why did the maker of OxyContin, Purdue Pharma unleash an epidemic of death and addiction throughout the country for almost two decades with virtually no concern or charges by any Attorney General as the body bag count mounted and we continue to lose a generation of our children?  Why did no federal agency consider charging Purdue Pharma under the Racketeer Influenced and Corrupt Organizations Act (RICO) in 2007 when they were charged in Federal Court in Virginia with criminally marketing OxyContin — pleaded guilty — and are convicted felons?

(MYRTLE BEACH) “RICO” is often thought of as a law designed to combat the Mafia. While that is how the law was first primarily used and intended, it has been applied in cases involving organizations that few people would mistake for the Mafia, including Major League Baseball, the Key West Police Department and the Catholic Church. RICO creates criminal and civil penalties for members of organizations that engage in patterns of criminal activity.  Why wasn’t Purdue Pharma charged under RICO?

There is an attorney in N.J. I refer to as the “Lone Ranger” fighting the prescription opioid epidemic destroying lives in the tens of thousands by taking appropriate legal action.  His name is Richard (Rick) Hollawell (photo shown).

(MYRTLE BEACH) Attorney Richard Hollawell has been seeking the very sought after 120 page report on Purdue Pharma, maker of OxyContin that caused the US Attorney’s office in Abingdon, VA to charge the pharmaceutical company in 2007 with criminally marketing their killer drug.  Three executives from Purdue Pharma pleaded guilty in Federal Court to the charges, Michael Friedman, Howard Udell and Paul Goldenheim.  No prison time was imposed and business continued as usual for Purdue Pharma.  So much so that eleven years later their profits surpass $30 billion with death and addiction tolls in the tens of thousands.

The FDA approved OxyContin for use in children to manage their chronic and extreme pain.  If you are wondering what could the FDA possibly have been thinking in approving a drug for children that has been responsible for tens of thousands of deaths and addictions throughout the U.S since its release in the late 1990’s, there was no thought.  Don’t even try to imagine how the FDA could have conducted studies with their research people and physicians under the watchful eyes of the heads of  the agency because they did not.  Did their advisory committee — the last step in approving a dangerous drug determine children could “safely” take OxyContin?  After all the FDA has come under close scrutiny for their financial ties to the pharmaceutical industry and certainly did not need anymore blood on their hands — especially with the risk of children becoming addicted and dying from OxyContin.   No there was no advisory committee review.
